Terms of Service

1. Introduction

Welcome to Jivan Healthtech ("Jivan", "we", "our", "us"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "Patient", "Provider") and Jivan regarding your use of our website (jivanhealthtech.in) and mobile application (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use immediately.

Crucial Notice: Jivan is a technology platform connecting patients with independent healthcare providers. We do not provide medical services directly and are not responsible for the clinical decisions of doctors, labs, or pharmacies.

2. Medical Services & Booking

A. Doctor Appointments

When you book an appointment, Jivan acts as an intermediary. While we verify provider credentials, we do not guarantee:

  • The complete accuracy of a Doctor's availability (delays may occur due to emergencies).
  • The outcome of any medical treatment or advice.

B. Telemedicine

For video consultations, you agree that remote diagnosis has limitations compared to physical examinations. In cases of emergency, you must visit a physical hospital immediately.

3. Pharmacy & Diagnostics

Medicine Delivery

Medicines are dispensed by third-party licensed pharmacies. You must upload a valid prescription for Schedule H/H1/X drugs. Jivan is not liable for manufacturing defects.

Lab Tests

Sample collection and testing are performed by NABL/CAP accredited partners. Report turnaround times are estimates and may vary.

4. Payments & Refunds

Fees: You agree to pay all consultation fees, lab charges, and medicine costs shown at checkout. Jivan may charge a convenience fee for platform usage.

Cancellations:

  • Free Cancellation: Up to 2 hours before the scheduled slot.
  • Late Cancellation: 50% of the fee may be charged if cancelled within 2 hours.
  • Refunds: Processed within 5-7 business days to the original payment source.

5. Clinic & Provider Subscription Plans

This section applies to Providers (clinics, hospitals, labs, and pharmacies) subscribing to a paid Jivan plan to manage their practice on the Platform. It does not apply to Patients booking appointments, which is covered under Section 4 above.

Free trial and mandate: Paid plans include a free trial period, stated on the pricing page and again at signup. Starting a paid plan requires setting up a payment mandate (UPI Autopay or card) at signup. This mandate is verified immediately with a small, fully refundable charge; your plan's actual price is not charged during the trial.

Billing after the trial: If you do not cancel before the trial ends, your mandate is used to charge your plan's price automatically, and billing continues on that cycle (monthly or yearly) until you cancel. You can cancel at any time from your dashboard; cancelling before the trial ends means nothing further is charged.

The exact trial length, mandate verification amount, and plan prices are the ones shown on the pricing page and at the point of signup – those numbers, not this general description, govern your specific plan.

6. Limitation of Liability

To the maximum extent permitted by Indian law, Jivan Healthtech shall not be liable for:

  • Any clinical negligence, misdiagnosis, or medical errors committed by Providers.
  • Delays in medicine delivery caused by logistics partners or unforeseen circumstances.
  • Technical failures preventing access to the Platform.

IN NO EVENT SHALL JIVAN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES EXCEEDING THE FEES PAID BY YOU IN THE LAST MONTH.

7. User Conduct & Termination

We reserve the right to suspend or terminate your account if you:

  • Provide false or misleading health information.
  • Abuse or harass healthcare providers or support staff.
  • Use the platform for unauthorized commercial purposes.
  • Repeatedly book and cancel appointments (No-Show policy).

8. Governing Law

These Terms are governed by the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Bhadrak, Odisha.
